1. Acceptance and eligibility
By accessing or using this service, you agree to these Terms of Service, our Privacy Policy, and any additional rules, instructions, or programme terms presented to you during registration, onboarding, or use.
You may use the service only if you are legally capable of entering into a binding agreement and are authorised to act in the relevant role, including as a rider, administrator, support agent, guardian, or delegate where applicable.
2. What the service does
DemandTrans Mobility provides digital tools for mobility programme access, rider onboarding, trip administration, reporting, subsidy operations, and related support workflows. Some parts of the experience may rely on Uber, transport operators, transit agencies, or other authorised third parties.
The platform itself is an administrative and digital access layer. Actual transport services, response times, and trip fulfilment may be delivered by third-party providers under their own operational rules and service constraints.
3. Accounts, credentials, and access
You are responsible for maintaining the confidentiality of your credentials and for activity that occurs under your account.
- Provide accurate and current registration and profile information.
- Use a secure password and safeguard devices used to access the service.
- Notify us promptly if you suspect unauthorised access or account compromise.
- Do not share credentials except where a programme specifically supports delegated access.
4. Acceptable use and security
You agree not to misuse the service or interfere with its operation.
- Do not attempt to bypass authentication, authorisation, or rate limits.
- Do not upload malicious code, scrape restricted data, probe for vulnerabilities, or reverse engineer protected components except where law expressly permits it.
- Do not submit false eligibility details, fraudulent trip activity, or misleading support information.
- Do not use the service in a way that infringes another person’s privacy, intellectual property, accessibility needs, or legal rights.
5. Programme compliance and accuracy
Eligibility, subsidies, rider status, and certain service capabilities may depend on government programme rules, partner contracts, or regulatory requirements. You agree to provide truthful information and to update information when it changes.
We may suspend features, request additional verification, adjust records, or deny access where information is incomplete, inaccurate, out of date, or inconsistent with programme requirements.
6. Third-party services and integrations
The service may incorporate or depend on third-party services, including authentication providers, cloud infrastructure, communications services, mapping tools, Uber systems, payment or transport partners, and transit programme integrations.
Those third parties may have separate terms, privacy notices, availability commitments, or technical requirements. We are not responsible for services that are outside our reasonable control.
7. Fees, charges, and reimbursements
Access to the platform may be provided under a programme, contract, or enterprise arrangement. Trip charges, subsidy adjustments, communications charges, mobile carrier fees, or other third-party costs may still apply depending on your role and the service used.
Where fare estimates, credits, or subsidy amounts are shown, they are subject to later validation, audit, and correction.
8. Intellectual property and limited licence
The service, including its software, interface design, content, trademarks, reports, and documentation, is protected by intellectual property laws and remains owned by us, Uber, or our licensors.
We grant you a limited, non-exclusive, non-transferable, revocable right to use the service for its intended programme and business purposes in accordance with these terms.
9. Availability, changes, and beta features
We may modify, suspend, or discontinue all or part of the service at any time to maintain safety, security, compliance, performance, or operational quality.
Some features may be labelled pilot, preview, or beta. Those features may change more frequently and may be subject to additional limitations.
10. Suspension and termination
We may suspend or terminate access immediately if we reasonably believe that you breached these terms, created security risk, violated programme rules, acted fraudulently, or exposed riders, partners, or the platform to harm.
You may stop using the service at any time. Certain obligations, including confidentiality, payment, liability, audit, and record retention provisions, survive termination where legally allowed.
11. Disclaimers
To the extent permitted by law, the service is provided on an “as available” and “as is” basis. We do not promise uninterrupted availability, universal transport coverage, error-free operation, or that every request, rider, document, or trip outcome will be accepted or completed.
Nothing in these terms excludes rights that cannot lawfully be excluded, including mandatory consumer guarantees and statutory protections that apply in your jurisdiction.
12. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, or opportunity arising from use of the service.
Where liability cannot be excluded, our liability is limited to the minimum amount permitted by applicable law and, where allowed, to resupplying the services or the reasonable cost of doing so.
13. Governing law and disputes
These terms are governed by the laws that apply to the contracting service entity and the relevant programme, except to the extent local consumer or privacy laws require otherwise.
Before filing a formal claim, you agree to contact us so that we can attempt to resolve the issue through support or operational review.
14. Changes to these terms
We may update these terms from time to time. When changes are material, we will post the revised terms with a new effective date and may provide additional notice through the service or by email where appropriate. Continued use after the effective date means you accept the revised terms.
